1. Agreement — you agree to these terms by using the free preview, and definitively by checking the agreement box and completing your subscription sign-up, or by paying a deposit — no physical or digital signature is required for this agreement to become binding.

2. Who can use our services — businesses only, not personal consumers; you confirm you're authorised to bind the business you represent.

3. Changes to terms — we email active subscribers before material changes take effect, with reasonable notice.

4. What we provide — Websites — subscription: deposit to launch, then a monthly fee covering hosting + Changes. Every website is built with a maximum of 5 pages (the Portfolio plan is limited to 1 page). Additional pages beyond that can be scoped and quoted separately on request. The Portfolio plan is intended for individual freelancers and personal-brand sites — a single-page site to showcase your work, without a product or service price list. If your business needs more than that, we'll recommend a Basic or FLEX plan instead.

5. The free preview — before paying anything for a website, you see a mock-up built around your actual business. Free, non-binding.

6. Pricing, deposits, payment — a one-time launch deposit (€350 for Portfolio, €500 for Basic and FLEX), then a monthly fee. Portfolio is €30/month. Basic is €55/month billed monthly, whichever of a 1- or 2-year commitment you choose — that monthly-billed rate carries no discount. Paying upfront instead earns a discount, since it's the prepayment being rewarded, not the length of the commitment: €46.75/month for 1 year paid in full (15% off), €44/month for 2 years paid in yearly instalments (20% off), or €41.25/month for 2 years paid fully upfront (25% off). FLEX is €75/month, no fixed term. All prices as shown on the site at signup. Your price locks in once you complete signup — see §8 for how it may change at renewal, and §26 for what happens to a prepaid amount if you cancel early. Your site goes live the same day your deposit clears, using the preview build we already showed you — so your monthly fee starts immediately, from day one. See §25 for what happens once you submit your content, and §16 for pricing if you transfer your website elsewhere early.

7. Subscription term, Changes, cancellation — Portfolio: €30/month, min. 12 months. Basic: €55/month billed monthly (1 or 2 year commitment), or a discounted prepaid rate per §6 (1 year upfront, 2 years paid yearly, or 2 years fully upfront). Cancel with 30 days' notice once your committed term ends. FLEX: €75/month, no fixed term, cancel any time with 30 days' notice. All plans include hosting and 5 Changes/month. Non-payment: suspended after 14 days, taken down after 30. See §28 for what stays due.

8. Price changes at renewal — your subscription price is fixed for the length of your committed term. When your term ends and you renew, we may increase your rate — but only up to that year's official Dutch inflation rate (CPI, published by the CBS), never to whatever price is offered to new customers at that time. You'll be notified of any renewal price change at least 60 days in advance, and any change applies only going forward, never retroactively.

9. Acceptable use — no illegal use, no impersonating a business you don't represent, no infringing others' IP.

10. Your Content — you keep full ownership of the content you provide us. You may request a copy at any time, free of charge. We use third-party tools to produce your deliverables. Some of these tools may use the content you submit to train or improve their own AI systems, under those tools' own terms.

11. The Website — the design, layout, code, and structure of your website remain the intellectual property of findbl. Your subscription grants you the right to have it live — it does not transfer ownership of the website itself.

12. Your Domain — if you register your own domain name, it remains fully yours at all times, independent of your subscription status.

13. Your Deliverables — once fully paid, your Content is yours to use. The Website remains subject to §11 regardless of payment status. Please review your content carefully before you publish or advertise it.

14. Showing Your Site In Our Portfolio — we may show the website we built for you — screenshots, a live link, and your business name — in our own portfolio, on our website, and in our social media and marketing, as an example of our work. This covers the finished site only, never your customer data or anything you send us in confidence. You can opt out at any time by emailing us, and we'll remove it.

15. When Your Subscription Ends — whether by non-payment or by your choice at the end of your committed term, hosting stops per the schedule in §7. Your domain is never affected. You may request your Content at any time, free of charge.

16. Website Transfer & Buyout — available as an optional Transfer & Handover service: (a) any remaining committed months, charged at your plan's rate, plus (b) a fixed handover fee of €250. This includes converting your site into a WordPress export via WPconvert.ai, so you can keep editing it yourself outside findbl. This covers the front-end design and content only. No backend, database, or dynamic functionality is included, so anything that relied on server-side logic won't carry over and would need to be rebuilt on your new platform. FLEX subscribers have no fixed term, so this service is available for the €250 fee alone, reflecting our real cost of exporting and migrating your site, not a penalty for leaving.

17. Hosting and availability — we host and aim to keep your site available, no specific uptime guarantee.

18. Other companies' services — payment, hosting, and font delivery are handled by other companies under their own terms.

19. Disclaimers — services provided "as is," to the fullest extent permitted by law. No guarantee of any particular business result.

20. Limitation of liability — total liability capped at what you paid in the prior 12 months.

21. Indemnification — you cover our reasonable costs if a claim arises from content you gave us that infringes someone's rights.

22. Term and termination — applies as long as you hold a subscription. Payment obligations, §10–§16, and §19–§21 survive termination.

23. Governing law and disputes — Dutch law; competent court in Amsterdam.

24. General — severability, no waiver by non-enforcement, no assignment without written consent.

25. Revisions — your site launches immediately once your deposit clears, using the preview build. Once you submit your content via the intake questionnaire, we implement it — your branding, photos, and copy — within 7 days. You then get up to two rounds of revisions on that implementation, at no extra cost. Once you've used both rounds, further changes are covered by your monthly Changes.

26. Refunds — the launch deposit is non-refundable once paid. Monthly fees already billed are non-refundable. Prepaid terms (1 or 2 years paid upfront under a discounted rate) are also non-refundable once paid, including if you cancel, or your business closes, before the term ends. The discount is granted in exchange for the prepayment, not for the length of the remaining term.

27. Data Processing Agreement — the terms of our Data Processing Agreement are incorporated into and form part of this agreement, in accordance with Article 28 GDPR.

28. Late payment and collection — (a) Payment term. Invoices are due within 14 days of the invoice date. Recurring fees are collected automatically on each billing date, using the payment method you set up at sign-up. (b) Late payment. If a payment isn't received by its due date, you're in default from that date without any further notice being needed. From then on you owe the statutory commercial interest (wettelijke handelsrente, art. 6:119a Dutch Civil Code) on the outstanding amount, plus the extrajudicial collection costs set by Dutch law (Besluit vergoeding voor buitengerechtelijke incassokosten). (c) Remaining term. If an amount is still unpaid 30 days after its due date, we may end your subscription, and all fees for the rest of your committed term (see §7) become due immediately, in one amount. FLEX has no committed term, so only fees up to the end of the 30-day notice period apply. Prepaid amounts you've already paid are covered by §26. (d) Reversed payments. Reversing a direct debit (storno) or disputing a card payment doesn't cancel what you owe. The amount stays due as an unpaid invoice. (e) Collection. We may pass unpaid amounts to a registered debt collection agency, lawyer or bailiff, and share the details they need to collect them.
